Lawyers representing Faridah Nambi, the National Resistance Movement (NRM) candidate in the Kawempe North by-election, have urged the High Court to annul the election of National Unity Platform (NUP) MP Elias Nalukoola, citing widespread irregularities and voter disenfranchisement.
Speaking to journalists outside court after filing their final submissions on Monday, lead counsel Ahmed Kalule said the legal team believes they have presented compelling evidence proving the election was not conducted by the law.

“We believe we have convinced the judge to annul the election of Elias Nalukoola as Member of Parliament for Kawempe North,” Kalule said, arguing that over 16,640 votes were never counted due to missing results from 14 polling stations, allegedly vandalized during the March 13 by-election.
The missing votes, Kalule stressed, far exceeded the margin between Nalukoola and Nambi. “That number is greater than the difference between the winner and the petitioner, putting the integrity of the entire election in doubt,” he said.
The petition, filed shortly after the violent by-election, contends that organized interference—including attacks reportedly carried out by individuals linked to senior NRM officials—led to the disappearance of electoral materials, thereby denying thousands of voters their constitutional right to choose their representative.
“We told the court that we cannot rely on speculation, voting patterns, or assumptions about who might have won in those polling stations,” Kalule added. “Without those results, there is no credible way to determine the winner.”

Nambi’s legal team argues that the law does not require them to prove who would have won, but merely to demonstrate that the outcome is unknown and cannot be verified due to the scale of the disenfranchisement.
The March 13 by-election in Kawempe North was marred by reports of violence and chaos, raising concerns among observers and electoral monitors. Nalukoola, running under NUP, was declared the winner with 17,764 votes against Nambi’s 8,593.
The High Court is expected to issue its ruling in the coming weeks
