In a decision dated December 4, 2025, the Commission ruled on a complaint lodged by Tukwasiibwe Amos under Article 61(1)(f) of the Constitution and Section 15 of the Electoral Commission Act, challenging Ategeka’s nomination by the Returning Officer on October 23, 2025.
The petitioner contended that Ategeka was nominated in contravention of Section 28(1)(c) of the Parliamentary Elections Act after three names of his supporters could not be validated for not being registered voters in Buyanja County. It was further stated that Ategeka whitewashed the rejected names and replaced them with Nkuuna David, Byamukama Joseph and Kiirabo Vicent, who did not append their signatures against their names.
Ategeka admitted substituting the names but maintained that the supporters had appended their respective signatures on the nomination paper.
After hearing the complaint, submissions from Ategeka and counsel for the petitioner, and considering the Returning Officer’s report, the Commission observed that Ategeka whitewashed three names on his nomination paper and replaced them upon advice that the original supporters were not registered voters in the constituency.
The Commission further noted that the names, villages and National Identification Numbers were whitewashed, except for the signatures, implying that the signatures belonged to the original supporters. The Commission said it was not satisfied with Ategeka’s explanation that the substituted supporters had signed the nomination paper.
As a result, under Minute MIN.COMP/058/2025, the Commission found that Ategeka did not comply with Section 28(1)(c) of the Parliamentary Elections Act. His nomination was consequently declared void under Section 30(a) of the Act.
